What is the European Accessibility Act (EAA)? And what does it mean for your business?

The European Accessibility Act (EAA) is set to positively and significantly impact disabled users by establishing common digital accessibility standards for businesses across the European Union (EU). It will take effect on 28th June 2025 and will impact businesses providing services and products to EU consumers – no matter where they’re based. Here’s what it means for you. 

What is the European Accessibility Act? 

The European Accessibility Act is a landmark piece of legislation aimed at improving the accessibility of products and services for disabled or older people across the EU. While it focuses on improving digital accessibility for EU consumers it applies to any company operating in the EU market – including the UK. 

Scope of the EAA: who’s affected? 

Unlike other accessibility legislation, such as the Public Sector Bodies Accessibility Regulations (PSBAR) 2018, the EAA is focused on the private sector and applies to any company with over ten employees and an annual turnover of €2 million. Micro-enterprises may have reduced obligations, but they are not completely exempt. 

What products and services are covered by the EAA? 

The EAA primarily focuses on products and services that are crucial for people with disabilities. Key requirements include: 

  • Websites and mobile apps: must meet Web Content Accessibility Guidelines (WCAG) 2.1. 
  • Ecommerce platforms: must provide accessible browsing, purchasing and payment options. 
  • ATMs, ticketing and check-in machines: must provide accessible interfaces, such as tactile feedback and screen reader support. 
  • Computers, operating systems, and smartphones: must include accessibility features like text-to-speech and compatibility with assistive technologies. 

What are the web accessibility requirements under the EAA? 

Companies must ensure their product or service meets the EN 301 549 standard – which includes the latest version of the WCAG standard. As of today, EAA compliance aligns with WCAG 2.1 standards, specifically Level AA. While not yet legally required, companies are encouraged to adopt WCAG 2.2 for more advanced accessibility guidelines.  

What is the EAA timeline? 

The Act was passed in 2019 and comes into force on June 25th 2025, at which point member states must begin applying the EAA’s accessibility measures. By 2030, companies must stop using inaccessible products and services and member states will start to report on the Act’s impact. 

How is it being implemented? 

For the EAA, each member country is required to publish its own laws and regulations. Companies that sell products and services covered by the Act must check the law relating to the EAA in their country to ensure compliance.  

 Are there penalties for non-compliance to the EAA? 

Non-compliance with the EAA could result in legal consequences and financial penalties. In some countries, like Ireland, non-compliance could even lead to prison sentences. Businesses that don’t comply might be missing out on the opportunity to serve a wider audience and demonstrate a commitment to accessibility.  Other notable sanctions already in place or under consideration are: 

  • Germany: considered administrative fines up to €100,000 for severe or repeated violations. 
  • France: proposed financial penalties and potential prohibition of products or services that don’t meet accessibility requirements. 
  • Italy: considered fines of between €5000 and €40000. 

How to prepare for the European Accessibility Act? 

 With less than one year to prepare for the EAA, businesses need to ensure their legal teams are aware of the Act and understand exactly how it affects them.
